Weingarten Rights
An Employee’s Right to Representation In 1975, the U.S. Supreme Court ruled that employees have the right to union representation at investigatory interviews. Management does not
have to offer employees these rights. It is up to the employee to make this request: “I have reason to believe that answers I may give to your questions could lead to disciplinary action. I request that my union representative be present at this meeting before I answer any questions. Without my representative present, I will refuse to answer any questions.”
